The Work Health & Safety Regulations 2011 establish the legal rights of workers to have a safe working environment. Specifically, Part 4.4, Clause 78 states “a person conducting business or undertaking at a workplace must manage in accordance with part 3.1, risks to health and safety associated with a fall by a person from one level to another that is reasonably likely to cause injury to the person or any other person”.

Therefore, property owners and anybody that is responsible for persons working at a height on a roof must provide a roof safety system. Safe access and appropriate height protection must be provided in order to provide a safe working environment.
